Republican Linda Schrenko, who in 1994 became the first woman elected to a statewide office in Georgia (!) and advocated the teaching of creationism in Georgia's schools, has been indicted (registration required on most links) on allegations she helped herself to over $500,000 of the people's money. Not just the people of Georgia's money. That wouldn't be right. In true Republican fashion, Schrenko is accused of redistributing money from the Blue States to her own personal account. Former Georgia School Superintendent Linda Schrenko, whose groundbreaking political career dissolved into erratic behavior and defeat, was indicted Wednesday on federal charges that she stole more than $500,000 in taxpayer money and spent part of it on cosmetic surgery.
Schrenko, 54; her close friend and chief assistant Merle Temple, 56; and Alpharetta businessman A. Stephan Botes, 47, were named in an 18-count indictment that alleges they were involved in a scheme to steal federal education funds and secretly funnel about half the money to Schrenko's failed 2002 campaign for governor.
In addition, the indictment charges the Republican school superintendent used $9,300 of the money to pay for cosmetic surgery. Schrenko allegedly filched the funds from programs for deaf students. The federal funds purportedly were used to purchase computer services for two state schools for the deaf and the Governor's Honors Program, but officials say the services weren't delivered. I guess we can leave some children behind for the sake of Republican politics and a more youthful appearance. Why waste money on the handicapped? Fortunately, God is on Schrenko's side. On Wednesday, Rusty Paul, former chairman of the Georgia Republican Party, said he listened in disbelief to news reports of Schrenko's indictment.

"She had a lot of support from the Christian conservatives in the Republican Party, both in her gubernatorial run and in her tenure as school superintendent," he said. I'm sure she did. A former teacher and principal whose only prior campaign was a losing race for school superintendent of Columbia County, Schrenko was first elected to head the $6 billion state Education Department in 1994, running a down-home campaign and with a 100 percent approval rating by the Christian Coalition. Once in office, she put personal friends on the DOE payroll, including her pastor and his wife. Schrenko was popular with the fundies because she advocated teaching the Bible and creationism in Georgia's public schools. The government alleges that Schrenko issued eleven Department of Education checks, ranging from $45,000 to $49,900, to companies controlled by Botes -- fifty K being the magic number requiring state Board of Education approval. Botes then allegedly funnelled the money back to Schrenko and her election campaigns, with the company hand-delivering checks to Schrenko's bagman. "In one instance, the government says, Temple met Botes and another company official for breakfast at an Atlanta hotel, and the Schrenko aide left with an envelope filled with $32,000 in cash." After an audit began, the govermnent claims, "the conspirators created backdated contracts to cover more than $500,000 in Department of Education payments made to Botes' companies." Schrenko denies the charges. Give that woman a Darwin Award! Linda Schrenko seems like quite the idiot.

Mr. Estrada arranged the fundraiser and only a few people were present, including Linda Schrenko and her campaign manager, Richard Leonard,
Rodney Estrada was working with other political candidates, including Mike Beatty for Lieutenant Governor, Kathy Cox, Republican candidate for State School Superintendent, and Joe Martin and Barbara Christmas, both Democratic candidates for State School Superintendent. Mr. Estrada also used the clubhouse in Mr. Botes’ community to have a fundraiser for Kathy Cox, Mike Beatty and Linda Schrenko. Stephan Botes specifically denied any knowledge or involvement in forming the company known as Curti Consulting Group International, which was formed by Johnny Turner and Rodney Estrada, for political action interests.
Rodney Estrada (restrada@alltel.net) of Estrada Consulting goes under the radar blaming his co conspirator Johnny Turner for the multiple checks going from his company Curti Consulting in the Linda Schrenko scheme. I remember one xmass/new year when he was still living in NJ when he took the office to upstate NY for an "all expense paid" weekend and many/many other times where he would get the dinner tab, the drinks tab etc.... Stephen would pay for all you leaches but now that he needs moral support.... you all desert him and smeer his name. On the other hand who needs people/ex girldfriends like you all.
I have known Stephen Botes for many/many years and i am shocked to see/hear how horrible you all are. Stephen is one of the most generous people i have met in a long time. Consider this Rodney, Should Stephen get a second chance on appeal, which is entirely possible, but not worth discussing the merits with you....And if such an appeal is granted, you have laid a foundation here that will in the least be fodder for the defense to show motive for your testimony, and it may be motive now for the appeal to prove your reasons for the lies you professed so rehearsed in court.
This WAS my intention the entire time, to show the courts your bias in this case. I have been paid by no one, but when the time is right, I will gladly testify to how I went about proving beyond a shadow of doubts your identity here and in private emails of CCSC employees, and your motivation for your testimony.
I find it ironic and sad, that someone who teaches the teachers to pass the praxis battery of tests to get certified, would not protect that which makes him good money.
This is my final post, as of now, I agree Rodney, I don't belong here.....anymore.

THE MOST IMPORTANT piece of this information is the IP Addresses MATCH. I sent the email to restrada@alltel.net, so, we have confirmed who we are dealing with, as if there was any doubt, but I just like to be thorough.

Well, Mr. Estrada, you sent some nasty, possibly illegal, emails to CCSC.COM, harrasing a female employee, you did this in June and before. I have them, the hardcopies, and it is being looked into.
I decided to lure you, call you out, to specifically identify YOU as who we thought you where. But I am a precise man, I never want to call out until I am sure. Go out and find the LEGAL tools available to know when an email is opened, they are out there, and no, they aren't illegal to use. Remember the internet is an opt in service, the buyer must beware and knowledgable of what their own PC will reveal about them.
No virus, no code, just good investigative drilling, and your irresistable desire to follow the road I laid out for you. There were times I thought you would not follow the crumbs. I am sure you will say things like you knew what was going on the whole time, or you did it intentionally, but we all know different.
Rodney, you are a dyed in the wool republican, we all know that, I plan on watching who Estrada Consulting associates itself with, maybe your potential clients need to know you for who you are, your viewpoints, and the hatred and animosity you hold for people you hardly knew, and how you speak to them in private emails.

First, You know little to nothing about "the code" I simply exploit what is wrong with IE and Firefox as it is built on 32bit windows. Switch to Linux, OS10 on Mac, or 64 bit Windows and the holes I exploit are gone. You can't DETECT or CLEAN it, the style sheet coding of WWW3 conventions has been exploited. So, there is no liability in anything I post, it only tracks where you post from, where you go when you leave, and how you got here, your IP address, your general location, your version of Windows, your email address as is registered with certain programs on your machine, your version of firefox or IE and a few other things you fail to keep to yourself. Simple things that most people know how to block, as it has been ADVERTISED adnauseum by MS and so many other security gurus out there.

All I know is that he stole from his employees, the very employees that remained with the company to the very end. These people worked hard for their money and didn’t get paid. CCSC failed to pay their 401K and Stephan was responsible for these people. Not a single e-mail to explain what was going on even after several attempts to contact the company to get paid.
From the other blogs I read, it sounded like other individuals had "bad dealings" with Stephan as well.
So whether he is innocent or not, he deserves to be in prison for the other crimes he has committed. There is a God.

Stephan had never even met her, knew nothing about her, did not have the cash (remember the company was supposed to be cash strapped) and had never presented their products and services to the DOE. Where was he going to get the money?
3. Why did Estrada craft the email invitation to the June 22, 2002 fundraiser and ask Stephan to send it to his staff from his company email account? Does framing come to mind?
4. Why did Turner pretend that the fundraiser held at the Country Club of the South was Stephan’s doing? Why did it take Stephan’s attorney 20 minutes and repeated instructions from the judge for Turner to answer the question before he slipped up and admitted it was Curti’s, his and Rodney Estrada’s company’s function? Does framing come to mind?
5. Estrada supposedly drives to South Georgia with Turner and they discuss Stephan’s insistence on giving Schrenko $250,000. He does not tell his business partner to go to the authorities, Estrada does not go to the authorities, but continues arranging fundraisers at Stephan’s house and negotiates a consulting agreement with Stephan for retainer and commission of contracts he brings Stephan’s Companies from the DOE?
6. Never having met or spoken to Temple,and having spent most of the month prior to the Estrada arranged meeting of June 3 2002, at Stephan’s office, why would Stephan within minutes of meeting the man conspire to supposedly help him steal from the DOE?
7. Why would Stephan, if indeed he did, agree with a person he had only just met a few minutes before, to commit a crime for which he could spend the rest of his life in jail?
8. For that matter, why would he have told Estrada that he wanted to commit a crime after having just met him a few weeks before?
9. Does it not sound like Estrada, who is the Educational Technology Consultant to the DOE, friends with Richard Leonard, Schrenko’s Campaign manager at this time, to be succeeded by Temple, a Deputy at the DOE and Schrenko’s closest ally, and himself the fundraiser for the Schrenko campaign, devised the scheme?
10. Why would Estrada in early April remind Stephan’s company that he refuses to work without a contract, that he does not work for free, and on June 27, 2002, without Stephen knowing they were going to get paid on June 28 for the Governor’s Honor’s Program, send Stephen an email reminding him of their deal and his commissions due?
11. Why does Stephan’s companies get paid by the DOE, business brought to them by Estrada, but despite the fact that Estrada never gets paid his commissions, by check or any way the company could identify, Rodney does not ask for the money, does not demand it and does not sue for it?
12. Why does none of the 23 checks Tuner laundered through his fathers company show up in Schrenko’s campaign? Mmmmm……
13. Why are 23 checks cashed in Orlando, Florida? At the same bank? Hhmmmm….

Why does Estrada, that assures Stephen’s companies on August 27, 2002, that he is still working diligently, who did not get paid his $15,000 retainer fro June, July and August, never ask for the money, never demands the money and never sues for it, but his buddy and business partner Turner draws $15,000 in cash, supposedly gives it to Bote’s who is never accused of having given it to anyone? Hhmmm…..
15. Why does Rodney Estrada testify to commissions for fund raisers of 7.5% when the cash drawn by Turner on the day CCSC gets paid on the Governors Honors Program equal 7.5%?

21. Why would the government use their preemptive strikes to eliminate while males from the jury of which 9 were African American and 9 were enemies, a statistical representation of the district or a planned strategy against a South African?
22. Why did the jury acquit Stephen of every single one of the 33 substantive?
23. Why did the jury on the afternoon before the verdict, pose the question, “if the defendant did not intend for a crime to be committed, should we still find him guilty?”

29. Why did Turner wait for Stephan to leave the country and be away for most of the month before presented the contracts to the company officers to sign?
30. Why were those contracts returned to the DOE two weeks before Stephan arrived back in the country?

Why would Linda Schrenko with nothing to gain or loose in answer to 15 separate questions on the subject testify that she had never had any conversations, any discussion, any agreement with Stephan to steal anything from anybody, but all she heard was hearsay from Merle Temple, who was not presented as a witness because he was a consummate liar and guilty of obstruction of justice?

Yes, the wife was mad, but not at me, we ended up sitting around for 45 mins during a ground hold program for aircraft heading into Miami, so I got caught up on some logbook entries.
I was an F-4 and F-16 pilot, in the USAF, and th F-16 had many nicknames, but buff was a B-52 designation.
We mostly called the F-16 Lawn Darts or Sweet Sixteen.
It's most apt name was Viper.

Yes, I got out of the military, worked for Rockwell missile systems division, then Boeing once they swallowed us up, helped to design the seeker circuitry in some of the shit we are using still today, and still consult on chip design. Chile, yes, the skiing is awesome there, not sure I will live there, but it is a good investment. The story about my sister is true, but I doubt she will live there permanently either. I am truly sickened by the Gov't in general, so it is easy to attack them now.

But, I may have been mistaken....I was lucky enough to finish as a block 40 driver, sure wish I had made it to the 50/52. Sad to see them almost retired now.

I will make a stop at Harry's by Gwinnett place mall to purchase monk fish, calamari, caper berries and other food stuffs. I then will cross over steve reynolds blvd. to go to sam's for beer, wine, bread and some other pleasantries.
By the way, I left my place of employment near pill hill traveled east on 285 to 85 and went north to, let's say around Jimmy carter blvd. This was done earlier.
Back to shopping, I then will got to the sport's authority to purchase some golf balls, a new driver hopefully and some tees. It is a new game to me and I think both sexes should be proficient in such a sport.
I then will traverse Steve Reynolds blvd again and take it down to Ribs over in Lilburn where I will dine.
I then will retire to home and maybe check to see if this helped you at all or if you want to resume our discussion of botes et. al.

I am not sure what your claim to fame is, but in the past 25 years, the USA has seen it's biggest rise in self made millionaires adjusted for inflation and Y2K dollars. In the last 15 years the USA has seen (IRS figures) 42.5% increase in personal foreign soil investment by those same now, relatively speaking, rich US citizens. I believe so many that have made it here the hard way, not "old money" as we say, see it as I do and have shipped a lot of their hard earned money off of US soil.
The US has become the melting pot of the world, running off to help every needy person in every other country, when they can't seem to fix our own problems right in our backyards. Trust me, I want every person who is illiterate here, to find a way up, and I am not opposed to helping them out with my tax dollars, but I am not willing to have my tax dollars go to so many waisted programs, where more is spent fattening the pockets of so many politicians and their cronies to run these programs.
Where are you complaining about all that theft, when you know it is clear that is what happens. Come on wake up. Look to the south of Chile with me :D, no on second thought, stay here, and continue to live in what once was a great country, unable to even see it's great past anymore.
I actually am laughing, because as I wrote this, I remembered speaking to my sister last month at a family wedding in Sanibel. We haven't spoken since 2001, as we had many differences of opinion over family affairs, and in that conversation she revealed to me she had bought a good bit of land just south of Chile. She had worked hard in her field and accumulated a good bit of wealth. I laughed at her, she laughed at me, then I revealed where my property was at, it seems we shall be fairly close to one another, maybe 20 minutes apart.
As far as finding BETTER than here, from a capitalistic standpoint, No way in hell, I agree totally. That which feeds me, pays for my kids college, and allows me to buy my property, my aircraft, my vehicles, and car washes and food chain locations will continue to exist here, I just won't be here.
But the freedoms granted us in the Bill of Rights, are long gone. We are no longer viewed as created equal, we don't treat people as such, and soon our two tier society will be complete, with very few in the middle anymore.
Please don't berate me for calling an ATLANTA jury what it is on one hand and claiming to want to help on the other. The jurors might coin it like this; "It is what it is". I only call it like I see it.
So, if I read you correctly, stay here and keep up the fight. Everything is cyclic, for your sake I hope it renews itself, but I doubt it.
P.S. I am not an attorney, rather I design VLSI circuitry. I do not have political interests, nor a Democrat or Republican, I vote my conscience. Thank God the 1st amendment is not dead here yet!

Atlanta Jury, the defense was given unlimited strikes during the voir dire process. The government has limited strikes and has to save them. Thus, the jury is a product of the defense attorney's all three of them. Steele, Theodocian and the last one that did nothing got to literally pick the jury that sat for trial. Please, at times you seem quite lucid in your discussion, don't lie to make your case, it cheapens your discussion line and argument.
Please, feel free to leave this country before you retire if necessary. If you think you can find better than the USA you are as foolish as the other Botes supporters herein.

I am buying as much property as I can in South America and in elsewhere, so when I retire, I can get out of this ever spiraling downward society I so once loved. The founding fathers would be preaching revolution again, if they could see what this country has become.
I am telling it as it was observed. Jury consultants have very little to work with in Atlanta, because so many are illiterate, government assisted, almost at poverty level people, who are pre-disposed to believe everything the gov't throws their way. Don't preach to someone who was born and raised here, when you were obviously not.
I never worked with SB, never did business with him, and at times disagreed with him and some of his philosophies, but I clearly see his subordinates for exactly what they were and are.... disgruntled, full of hate for a man who had so much more than them, and they just had to have a piece of it at any price.

I HATE that I have to contrast Hitler's complete involvement, leadership, planning, philosophies, etc... with the Shrenko, Temple, Botes, Steyn, Turner trial. They are not even in the same universe.
Makes me feel like a strange bedfellow of Hitler.
Point 4 and point 18 of the Nazi party belief's seems to easily associate Hitler with his atrocities during the Holocaust, penned by Hitler himself. He felt and spoke many times about Marxism aligning the Jews and Marxism together.
I truly do not see the nexus between the two.
The back of the checks show many where cashed in Stockbridge, Ga. regardless of where they lived. Don't you see how far away from her hometown they were trying to get when cashing these checks?? They did try to use a little intelligence, but still had to use the same bank.
You again reference what you have seen on links online, only what the GOV'T would allow to be shot. Have you actually held the checks in your hand? How about full front and back copies of these checks?
The sad, really sad part of this is, there is a whole scheme that so clearly came to light, percentages and all, and if you are reading, 22 1/2% to be exact, doled out to the three whom were stealing from Linda, The DOE and from CCSC. The amount of money making into each checking account of those perpetrators is EXACTLY 22.5%. Not a few dollars or pennies off, exactly what the FBI and the DOE investigators supplied.
For reasons unknown to me, but I believe it was a decision, an ill-fated one, to not tire or bore the jury with that which they could not follow. I do not know what the future holds for this evidence, but it is there.
I am not one to believe our judicial system gets it wrong even seldom, but every now and then, the prize, one of Linda Shrenko's size, causes a very myopic view of the circumstances. I honestly believe this trial could be done over, with just a few changes, and the outcome would be so different.
My last point, is case in point for how the government goes about pressuring people who are clearly innocent. They did this to the point of coercion and ultimately charged him with the same crimes the others were charged with, with very little chance of conviction.
Peter Steyn, SB right hand man, was not involved, and knew nothing, but when cornered, interviewed, and threatened, sure made some very disparaging statements in an attempt to save his ass.
If you know Peter, he is by nature a very nervous man. Nervous does not equate to guilty, unless you happen to be the FBI, in this case. I believe he regrets not being adamant in defense of SB.
PS had no knowledge of JT's and MT's and RE's scheme, and luckily, his attorney had his shit together to bear that out! I have seen PS and SB interact with one another, many times, if one knew they both knew, and both should have been cast the same result.
So at this point, I will refrain from adding any more thoughts here, or any more arguments, or any more responses. Please, lets not post unpleasantries about people clearly not involved, i.e. His new wife (just eewww).
I tend not to think you are SB ex-wife, but if you are, it explains alot....

Excellent points, however, it is a common enough tactic to mitigate the facts that are vulnerable and thus make the entire argument about what parts you choose to denigrate. Thus ignoring the vast breadth of evidence that added to and completed the many facets of the the prosecutions case.
Also, one or two get charged? How about 7 and all of them except stephan eventually admit their guilt and included stephan in their explanation of what happened.
Stephan never got linked to diddly, yeah right. This argument is used so very often by those who believe in "plausible deniability". A major philosophy of Stephan's and one he tried to milk and lost. Furthermore, do the research, the holocaust clearly was the fault of Hitler, however, there are no written orders, recordings or anything else that ties that asshole to the death of the jews. So don't give me Stephan never got tied by a signed paper trial thus he was not involved. Utter hogwash.
Also, the decision to charge by any agency is usually premised upon "culpability". The degree to which can and is measureable in every situation. Those most culpable are easy to detect and thus prosecute. Stephan and Temple were most culpable and thus most targeted.
I do agree this trial went so far do to the public profile of Schrenko and others. Sad but obviously necessary. Look at the new hotline the fbi set up to allow other whistleblowers to report public officials.
Stephan got mixed up with not only crooked public officials but stupid ones.
p.s. the bulk of the checks according to the signature lines at www.wrdw.com were signed and handled by folks in and around augusta. Not by Johnny's family and friends. Might help you to know that

If you think the Federal Government actually goes after everyone involved in crime, including white collar crime, you have shown your true naivety.
Their Modus Operandi is to find on or two complicit in the crime without a doubt. then find one that they don't charge to then be the one they put before the jurors to overcome the defense's appeal to not believe the JT's of the world, as they have everything to gain in testifying now, also known as a lighter sentence. Hell, it was proven in court JT's sentence was tied to exactly how he performed and his agreement was a percentage of the other sentences given out. THAT IS HOW THE GOV'T OPERATES. Really is that news to any of you??
It is amusing to watch how when the GOV'T is accused of wrong doing, those people that come out of the wood work to get on their soapbox, and then defend the same GOV'T's actions when they obviously can't look at something objectively, because they are too clouded with hate of the individual.
A true finder of fact casts aside their political affiliations, their uneducated belief in the facts. This was not the case hear. Granted their was some damning evidence, but there was not one contract, one check, one photograph, that Mr. Botes penned, or pictured in.
Great investigation. Raise the telephone call recording all you want, one was excluded from evidence in it's entirety, and parts of the other where stricken, and only those parts that were allowed in, where read into the record and provided in written form to the jurors due to the fact the stricken parts were unintelligible.
Never was the tape allowed to be played in court!!!.

The evidence did show that more than 90% of all the checks being cashed were by relatives and friends of one Johhny Turner. They were mostly cashed in Stockbridge Georgia.
I am intimate with this case, most of you get your information from what you heard in court, or much less what you read in the papers. Their is no such thing as investigative reporting, likened to the days of Watergate, in which Bob Woodward and Carl Bernstein FOUND the TRUTH. The AJC was mostly represented by Beth Warren, come on, nothing more than a puppet, and Stephen's so called media advisor was no help, admittedly.
In this particular case, it was nothing more than personal payback (please don't let this be a REP vs DEM thing) for Shrenko's almost causing the gubernatorial race into a runoff, not because she had a chance, I wouldn't have voted for her, but she did have the chance if she ran a proper campaign, to steal enough votes away from her contender to force a runoff. For the record, I think Sonny is doing an ok job, at least he is friendly.
I am sure there will be more spoutings by those who used to work for SB, and even more from some of my contemporaries. That is why I love this country so, we can both have a difference of opinion and spell it out here....You just can't have a different opinion with the government. One can only wish we could go back to when we were truly represented by the Government, not controlled and handled so easily.

Take a look at the interviews in which Schrenko corroborates the complicity of Stephan in the crimes.(Meetings which Stephan admits to being at how odd!!)
Take a look at the vast amounts of evidence piled up against him. Stephan is a fool for not just owning up to his crimes.
As far as whether or not he is a fish or a lion or whatever, I’m not good with those metaphors, I suggest we just continue to call him an asshole.
As far as continuing to cast stones at those not charged, don’t you think for an instance the government did not thoroughly go through anyone even remotely tied to this crap. If you think otherwise you are a deluded and a fool.
Many of us that know Stephan know his family disowned him years ago for being a basic asshole.
His new wife (just eewww) should one day find out that prison sentencing guidelines are inclusive of marital status. He married you for a reason honey, he could use you for his own needs.

I must give credit where credit is due. Rodney Estrada saved his ass by selling the FBI a story that they could sell to an ATLANTA jury. 1/3 of them slept at times during testimony, as I was there everyday. Judge Cooper even nodded off twice in my attendance. RE's along with JT's testimony was SO rehearsed, that I believe they must still dream about it to this day.
Someone posted earlier they respected those that admitted, and PLEAD out. That is the way of the court system. I respect someone who at all costs, will go down with a fight.
I remember a movie once where the USA capitalistic ways were likened to the Great White Shark, one of the more ferocious creatures in the Sea. Don't they hang out off the coast of South Africa....hmm not sure.... With that anology, Stephen Botes is the epitome of a capitalist Shark. More power to him!!!
97 months is a long time, time, that for some people, is just the motivation to return to that from which they came. Granted, he will be deported immediately, but for those who once swam with him like feeder fish, are now searching for another host to feed off of.....might just want to watch out for the Great White shark, who will have 97 months to plan his return to warmer waters. They say every self made millionaire goes broke at least once, well glad he got it out of the way so young!!!

The Judge handed Stephan an 8 year sentence similar to Linda Schrenko and Temple. Aside from my own previous personal anger towards him, I cannot help but to feel genuine compassion for him. I previously wished the Judge would throw the book at him and he suffer the effects of incarceration. I celebrated with glee with my associates when the verdicts were read. Looking back, wishing the worse on Stephan wasn't right, no matter what I personally feel or have gone through with him.
Yes, he was found guilty by a jury of his peers and I am convinced he is involved in wrongdoing with the incident. I do respect him in the capacity of creating businesses and giving people the opportunity to be gainfully employed.
Did Stephan hurt kids? Most likely, with federal funds rediverted to a political campaign. I frequently read about child-molestors inflicting much greater pain on children and all they receive is a slap on the wrist receiving house-arrest for a year. To me, there seems to be an inequitable result.

PURPOSE OF REQUEST:
Howard J. Weintraub, Attorney at Law, contacted the Federal Polygraph Associates, LLC, Atlanta, Georgia, and requested a forensic credibility assessment of his client, A. Stephan Botes. Mr. Botes is the Chairman and Chief Executive Officer of Computer Consulting Services Corporation (CCSC), as well as other affiliated companies, including Uniting Networks, Inc. and Global Executive Management, LLC. Mr. Botes was charged in a federal indictment alleging that Mr. Botes conspired with Linda C. Schrenko, State Superintendent of Schools and Merle Temple, Jr., former Deputy State School Superintendent, and others, to defraud the Georgia Department of Education in 2002. Linda C. Schrenko was a candidate for Governor of Georgia in 2002 and Merle Temple Jr., served as a consultant to the State School Superintendent. Mr. Botes was alleged to have participated in a scheme with Linda C. Schrenko and Merle Temple, Jr. to defraud the Georgia Department of Education through materially false pretenses by causing checks to be issued by the State of Georgia in excess of $500,000 for goods and services never received. Mr. Botes was also charged with directing the CCSC Comptroller to divert funds received from the Georgia Department of Education into the gubernatorial campaign funds of Ms. Schrenko.
PRIVILEGED AND CONFIDENTIAL
RIGHTS AND TESTING PROCEDURES:
Mr. A. Stephan Botes was scheduled for forensic interview and testing by Richard D. Rackleff, Board Certified Forensic Examiner, American Board of Forensic Examiners. Prior to conducting any assessment of Mr. Botes’ credibility, the scientific basis of the polygraph procedures were explained in detail to the examinee and he was advised the testing would be conducted and evaluated using professional testing standards and scientific procedures which had been validated through continuous research in the scientific community. The examinee was advised that his participation in a forensic polygraph evaluation would be completely voluntary. He was provided with a Statement of Consent and Waiver, which he read and verified with his signature. The examinee was encouraged to be completely truthful during the testing process and was advised a Forensic Polygraph Report would be made available to his attorney, relative to his credibility.
The initial interview of Mr. Botes was conducted on December 1, 2004, at which time he provided personal background information and details of his involvement with Linda C. Schrenko and Merle Temple, Jr. in the gubernatorial campaign in 2002. A Forensic Psychophysiological Veracity Assessment was then scheduled and conducted on December 9, 2004, relative to his denial of any knowledge or involvement in diverting funds to the gubernatorial campaign of Linda C. Schrenko.
A. Stephan Botes was again interviewed on January 27, 2005 relative to the business transactions between his company, Computer Consulting Services Corporation (CCSC), and the Georgia Department of Education (GA DOE), through the offices of Linda C. Schrenko. A second Forensic Psychophysiological Assessment was then conducted on February 2, 2005, relative to the charges and allegation that the contracts between the CCSC and the GA DOE were a scam and no goods or services were ever provided to the State of Georgia by CCSC.
PRE-TEST INTERVIEW:
During the interview on December 1, 2004, the examinee voluntarily provided identifying and background information. Mr. Botes provided complete background and history of CCSC, which was started in 1982. Mr. Botes has served as President and CEO of CCSC since 1986. Uniting Networks, Inc. was started in 1987 and Global Executive Management Ltd. was started in 1998. He explained other companies were formed with separate product lines, including MyCommunityServer, SchoolServer, MaestroPro and PowerResearcher. Jonathan “Johnny” Turner started in the company in a clerical position in accounting in 1998 and moved up the ranks until he became Vice President of Finance.
Around January 2002, Johnny Turner introduced his friend, Rodney Estrada to Mr. Botes. Mr. Estrada was an Educational Technology Consultant who had connections with the several State Departments of Education, including Georgia. Mr. Estrada was interested in representing Mr. Botes’ software to various school systems and started working as a consultant to CCSC in February 2002. The schools were interested in the No Child Left Behind program which required them to have a student information management system and SchoolServer was such a product. CreState School Superintendent, Linda Schrenko, in April 1999 with their software product, MaestroPro, which was marketed as an intellectual capacity expander. The product was effective in teaching students study methodology. Rodney Estrada arranged a meeting with Linda Schrenko in April 2002 at which time the software products were demonstrated. The Superintendent was very interested and agreed to purchase the PowerResearcher software product for the Governor’s Honors Program in Valdosta, in June 2002.
Rodney Estrada, who was also a fundraiser for political campaigns, approached Mr. Botes about using his home for a fundraiser for Ms. Schrenko, who was a candidate for Governor. Mr. Estrada arranged the fundraiser and only a few people were present, including Linda Schrenko and her campaign manager, Richard Leonard, in addition to CCSC employees. The employees were encouraged to donate $100 each and Mr. Botes gave $100, which he stated were the only funds he ever donated to the Linda Schrenko campaign. Rodney Estrada was working with other political candidates, including Mike Beatty for Lieutenant Governor, Kathy Cox, Republican candidate for State School Superintendent, and Joe Martin and Barbara Christmas, both Democrat candidates for State School Superintendent. Mr. Estrada also asked to use the clubhouse in Mr. Botes’ community to have a fundraiser for Kathy Cox, Mike Beatty and Linda Schrenko. Stephan Botes specifically denied any knowledge or involvement in forming the company known as Curti Consulting Group International, which was formed by Johnny Turner and Rodney Estrada, for political action interests.
The GA DOE awarded Mr. Botes’ company two Governors Honors Program contracts in June 2002. The company created a GA DOE requested website for such purpose, installed the software on the lab computers in Valdosta, taught two classes for teachers and students on the use of the software, created and conducted surveys for a Needs Assessment report and provided support and maintenance personnel for the duration. Lack of response from the GA DOE delayed the completion of the Needs Assessment Report, resulting in several extensions of the delivery date, and final delivery on December 31, 2002.
In early June 2002, CCSC was also requested to make presentations to, and do proposals for, the School District in Richmond County and the School District of Emanuel County, both $2.5 million contracts. While awaiting approval on those contracts, CCSC was awarded another $2.5 million contract by the GA DOE on July 21, 2002, and 15,000 PowerResearcher and MaestroPro software license keys were delivered and signed for by Ms. Schrenko, for which Mr. Botes’ company was never paid. Linda Schrenko wanted to do something notable for the Schools for the Deaf and in late July, awarded Mr. Botes’ companies eleven contracts for their software and services, to benefit these schools and the GA DOE. Mr. Botes claimed his companies delivered everything that was in their power to deliver, including all the license keys for the software purchased, and stood ready willing and able to complete delivery on all the contracts, at all times, but that they were hindered, obstructed and prevented from completing delivery, because of the political conflict and infighting between Republican Linda Schrenko, and the Democrat State Board of Education. Mr. Botes’ companies received a letter from the Chairperson of the State Board of Education in late August 2002, challenging Schrenko’s authority to have entered into those contracts. Mr. Botes instructed his legal counsel to investigate and to contact the State Attorney General, which they did. He stated that a March 28, 2002 letter opinion from the State Attorney General confirmed Schrenko’s authority, and Mr. Botes’ companies awaited word to proceed with completing delivery. Repeated attempts failed and they were stalled and prevented from completing delivery by the lack of responses from GA DOE personnel, apparently due to conflicts within the GA DOE. In late November 2002, they received another notice that the State Board of Education had voted to void the contracts and had called for return of the funds paid. Mr. Botes again instructed his legal counsel to contact the State Attorney General, which they did.
Although the software license keys had been delivered for the eleven July contracts, no installations were ever completed and the deliverable date for the software and services kept being postponed. The contracts required specialized customization, support and maintenance, for which expensive and highly qualified staff was held on standby through the end of December 2002. This consumed all of the funds paid to Mr. Botes’ companies by the GA DOE. The software was subsequently installed by the GA DOE, at the GA Educators Training and Technology Center (ETTC), where they were teaching teachers on the use of the software, to teach students on conducting online research.

Although issuing of “Focus Group” checks would not have been unusual for his company, Stephan Botes was not aware that Johnny Turner dispersed 54 such checks from Botes’ companies and another 50 of them from two companies Mr. Botes had no knowledge of, and did not control controlled by Johnny Turner and his father, designated “Focus Group Honoraria”, in June 2002. Mr. Botes’ companies had demonstrated their products to two large focus groups in March 2002, and paid each attendee, teachers, students and businessmen, $350 for a four-hour session, through April 2002. Survey data was collected and the sessions were recorded and considered very useful in marketing and improving the software.
Mr. Botes insisted that he was unaware of the amounts of cash Mr. Turner was drawing from the company and the purpose, and that the only payments Mr. Botes authorized and made to Merle Temple, were pursuant an agreement calling for commissions on the $2.5 million contract Temple had procured for Mr. Botes’ company on July 21, 2002.
Stephan Botes confirmed that his affiliated companies were formed to represent each of his software products, based on the professional advice of his auditors, BDO Seidman. He denied affiliated companies were formed for the purpose of concealing diversion of funds to the Georgia School Superintendent or her associates. He emphasized that the CCSC contracts with the Georgia Board of Education were legitimate and explained that the company has conducted business transactions in more than thirty States and numerous foreign countries for over two decades, without any questionable transactions or accusation thereof. Some of the education software products were first released in early 2002, and Georgia happened to be the first State in which these products were actually sold. PowerResearcher, which was previously known as ScoutAbout, was released in April 2002. He added CCSC has been providing consulting services to numerous State and Federal agencies, as well as defense contractors and Fortune 500 companies, for more than 15 years.
Stephan Botes categorically denied any conspiracy with Linda C. Schrenko or Merle Temple to divert funds to her gubernatorial campaign. He further denied any involvement in fraudulent business transactions between Computer Consulting Services Corporation and the Georgia Department of Education.
TESTING PROTOCOL:
Mr. Botes was advised that the Forensic Psychophysiological Veracity Assessment would be conducted in accordance with the standards of the American College of Forensic Examiners, (ACFE), Objective Scientist Model, which states, "Board Certified Forensic Examiners are not considered advocates, seek only the truth in conducting examinations and report findings in an unbiased and objective manner".
A Forensic Psychophysiological Veracity Assessment was conducted in accordance with professional certification standards for specific incident testing. The test was administered and evaluated using scientific principles and standards of practice set forth by the American Polygraph Association and American Association of Police Polygraphists. The collection of test data was conducted using a Lafayette LX 4000 Computer Polygraph System, which is a state-of-the-art digital polygraph system used by most law enforcement agencies. The test questions format used was a Zone Comparison Testing format (ZCT), which is a control question format developed and modified for use in specific incident testing. The ZCT is professionally recognized as a valid and reliable question format. A recent study conducted by the National Academy of Sciences concluded polygraph testing when using a comparative test question format in specific incident testing, was more reliable and valid than other testing formats. The ZCT is currently used in the training of examiners by the Department of Defense Polygraph Institute (DoDPI), and all polygraph training facilities which have been certified by the American Polygraph Association. The DoDPI is considered to be the premier polygraph training and research facility in the world. The ZCT testing format was also used in the research and development of digital scoring algorithms conducted by the Applied Physics Laboratory, Johns Hopkins University.
The credibility assessment of the examinee consisted of three phases the pre-test interviews during which the target issues were discussed and the test questions were formulated the collection of test data during which the psychophysiological responses were monitored and recorded on the test charts and the post-test phase during which the recorded data were reviewed and evaluated. Each forensic psychophysiological assessment consisted of multiple data charts, recorded, printed and evaluated using the Lafayette LX 4000 computerized polygraph system.

Additional interviews were conducted relative to the business transactions between CCSC and GA DOE. A second test series was administered on February 2, 2005, which included the following relevant test questions.
Were any software product licenses or related support services related to the Georgia Department of Education contracts, withheld from delivery? No
After receiving payments from the Georgia Department of Education in 2002, did your companies make every effort to deliver the software products and services in full accordance with the contracts? Yes
Were the affiliated companies incorporated in July 2002, based upon the advice of BDO Seidman for tax purposes? Yes
EVALUATION OF TEST DATA:
The recorded test data recorded on each of the test series were printed and numerically evaluated using the conventional seven point scoring system, used by federal law enforcement polygraph experts. A global analysis of the entire psychophysiological data, recorded during the testing process on each test series, reflected no significant reactions to the target issues on either test series, which would reflect deceptive criteria. The test data were also electronically reviewed and evaluated using the digital scoring algorithm developed by the Applied Physics Laboratory, Johns Hopkins University, during research conducted by the government.
CONCLUSION:
The overall scoring of the test data collected and recorded for each of the above relevant questions reflected No Deception Indicated. In the opinion of the forensic examiner, the credibility assessment clearly supported the denial of A. Stephan Botes of any participation in any conspiracy to divert federal or state funds into the political campaign of Linda Schrenko or involvement in any effort to defraud the Georgia Department of Education through bogus contracts in providing educational software to Georgia school systems.

PURPOSE OF REQUEST:
Howard J. Weintraub, Attorney at Law, contacted the Federal Polygraph Associates, LLC, Atlanta, Georgia, and requested a forensic credibility assessment of his client, A. Stephan Botes. Mr. Botes is the Chairman and Chief Executive Officer of Computer Consulting Services Corporation (CCSC), as well as other affiliated companies, including Uniting Networks, Inc. and Global Executive Management, LLC. Mr. Botes was charged in a federal indictment alleging that Mr. Botes conspired with Linda C. Schrenko, State Superintendent of Schools and Merle Temple, Jr., former Deputy State School Superintendent, and others, to defraud the Georgia Department of Education in 2002. Linda C. Schrenko was a candidate for Governor of Georgia in 2002 and Merle Temple Jr., served as a consultant to the State School Superintendent. Mr. Botes was alleged to have participated in a scheme with Linda C. Schrenko and Merle Temple, Jr. to defraud the Georgia Department of Education through materially false pretenses by causing checks to be issued by the State of Georgia in excess of $500,000 for goods and services never received. Mr. Botes was also charged with directing the CCSC Comptroller to divert funds received from the Georgia Department of Education into the gubernatorial campaign funds of Ms. Schrenko.
PRIVILEGED AND CONFIDENTIAL
RIGHTS AND TESTING PROCEDURES:
Mr. A. Stephan Botes was scheduled for forensic interview and testing by Richard D. Rackleff, Board Certified Forensic Examiner, American Board of Forensic Examiners. Prior to conducting any assessment of Mr. Botes’ credibility, the scientific basis of the polygraph procedures were explained in detail to the examinee and he was advised the testing would be conducted and evaluated using professional testing standards and scientific procedures which had been validated through continuous research in the scientific community. The examinee was advised that his participation in a forensic polygraph evaluation would be completely voluntary. He was provided with a Statement of Consent and Waiver, which he read and verified with his signature. The examinee was encouraged to be completely truthful during the testing process and was advised a Forensic Polygraph Report would be made available to his attorney, relative to his credibility.
The initial interview of Mr. Botes was conducted on December 1, 2004, at which time he provided personal background information and details of his involvement with Linda C. Schrenko and Merle Temple, Jr. in the gubernatorial campaign in 2002. A Forensic Psychophysiological Veracity Assessment was then scheduled and conducted on December 9, 2004, relative to his denial of any knowledge or involvement in diverting funds to the gubernatorial campaign of Linda C. Schrenko.
A. Stephan Botes was again interviewed on January 27, 2005 relative to the business transactions between his company, Computer Consulting Services Corporation (CCSC), and the Georgia Department of Education (GA DOE), through the offices of Linda C. Schrenko. A second Forensic Psychophysiological Assessment was then conducted on February 2, 2005, relative to the charges and allegation that the contracts between the CCSC and the GA DOE were a scam and no goods or services were ever provided to the State of Georgia by CCSC.
PRE-TEST INTERVIEW:
During the interview on December 1, 2004, the examinee voluntarily provided identifying and background information. Mr. Botes provided complete background and history of CCSC, which was started in 1982. Mr. Botes has served as President and CEO of CCSC since 1986. Uniting Networks, Inc. was started in 1987 and Global Executive Management Ltd. was started in 1998. He explained other companies were formed with separate product lines, including MyCommunityServer, SchoolServer, MaestroPro and PowerResearcher. Jonathan “Johnny” Turner started in the company in a clerical position in accounting in 1998 and moved up the ranks until he became Vice President of Finance.
Around January 2002, Johnny Turner introduced his friend, Rodney Estrada to Mr. Botes. Mr. Estrada was an Educational Technology Consultant who had connections with several State Departments of Education, including Georgia. Mr. Estrada was interested in representing Mr. Botes’ software to various school systems and started working as a consultant to CCSC in February 2002. The schools were interested in the No Child Left Behind Program which required them to have a student information management system, which the SchoolServer. product provided. Representatives of CCSC had first approached the State School Superintendent, Linda Schrenko, in April 1999 with their software product, MaestroPro, which was marketed as an intellectual capacity expander. The product was effective in teaching students study methodology. Rodney Estrada arranged a meeting with Linda Schrenko in April 2002; at which time the software products were demonstrated. The Superintendent was very interested and agreed to purchase the PowerResearcher software product for the Governor’s Honors Program in Valdosta, in June 2002.
Rodney Estrada, who was also a fundraiser for political campaigns, approached Mr. Botes about using his home for a fundraiser for Ms. Schrenko, who was a candidate for Governor. Mr. Estrada arranged the fundraiser and only a few people were present, including Linda Schrenko and her campaign manager, Richard Leonard, in addition to CCSC employees. The employees were encouraged to donate $100 each and Mr. Botes gave $100, which he stated were the only funds he ever donated to the Linda Schrenko campaign. Rodney Estrada was working with other political candidates, including Mike Beatty for Lieutenant Governor, Kathy Cox, Republican candidate for State School Superintendent, and Joe Martin and Barbara Christmas, both Democratic candidates for State School Superintendent. Mr. Estrada also used the clubhouse in Mr. Botes’ community to have a fundraiser for Kathy Cox, Mike Beatty and Linda Schrenko. Stephan Botes specifically denied any knowledge or involvement in forming the company known as Curti Consulting Group International, which was formed by Johnny Turner and Rodney Estrada, for political action interests.
The GA DOE awarded Mr. Botes’ company two Governors Honors Program contracts in June 2002. The company created a GA DOE requested website for such purpose, installed the software on the lab computers in Valdosta, taught two classes for teachers and students on the use of the software, created and conducted surveys for a Needs Assessment Report and provided support and maintenance personnel for the duration. The Needs Assessment Report was delayed due to a lack of response from the GA DOE, resulting in several extensions of the delivery date, and final delivery on December 31, 2002.
In early June 2002, CCSC was also requested to make presentations to, and do proposals for, the School District in Richmond County and the School District of Emanuel County, both $2.5 million contracts. While awaiting approval on those contracts, CCSC was awarded another $2.5 million contract by the GA DOE on July 21, 2002, and 15,000 PowerResearcher and MaestroPro software license keys were delivered and signed for by Ms. Schrenko. Mr. Botes’ companies were also awarded eleven contracts by the GA DOE for their software and services, to benefit the Schools for the Deaf. Mr. Botes claimed his companies delivered everything that was in their power to deliver, including all the license keys for the software purchased, but were prevented from completing delivery because of the political conflict and infighting between Linda Schrenko and the State Board of Education. Mr. Botes’ companies received a letter from the Chairperson of the State Board of Education in late August 2002, challenging Schrenko’s authority to have entered into those contracts. Mr. Botes instructed CCSC legal counsel to contact the State Attorney General. They received on opinion letter from the State Attorney General on March 28, 2002 which confirmed the authority of the State School Superintendent to issue multiple contracts with Mr. Botes’ companies. They were prevented from completing delivery due to the lack of responses from GA DOE personnel. In late November 2002, they received another notice that the State Board of Education had voted to void the contracts
Mr. Botes explained the contracts required specialized customization, support and maintenance, for which qualified employees were held on standby through the end of December 2002. He added their software was subsequently installed by the GA DOE, at the GA Educators Training and Technology Center (ETTC), where teachers were instructed on the use of the software in teaching students on conducting online research.
Although issuing “Focus Group” checks would not have been unusual for his company, Stephan Botes was not aware that Johnny Turner dispersed 54 such checks from Mr. Botes’ companies designated for “Focus Group Honoraria” nor was he aware of the 50 additional checks dispensed through two other companies in which Mr. Botes had no knowledge or affiliation, but apparently controlled by Johnny Turner and his father. Mr. Botes’ added his companies had demonstrated their products to two large focus groups in March 2002, for which each attendee, teacher, student and businessman, was paid $350 for a four-hour session. The survey data were collected through April, 2002 and the sessions were recorded and considered very useful in marketing and improving their software.
Mr. Botes insisted that he was unaware of the amounts of cash dispersals which Mr. Turner was drawing from the company pursuant to the GA DOE contracts. The only payments Mr. Botes authorized were pursuant to an agreement with Merle Temple, Jr. for commissions on the $2.5 million contract Temple had procured with the GA DOE on July 21, 2002. Stephan Botes confirmed that affiliated companies were formed in June, 2002, to represent each of his software products, and based upon the professional advice of his auditors, BDO Seidman. He denied any affiliated companies were formed for the purpose of concealing any diversion of funds to the Georgia School Superintendent or her associates.
Mr. Botes emphasized that CCSC has conducted business transactions in more than thirty States and numerous foreign countries for over two decades, without any questionable transactions or accusation of fraud. The PowerResearcher product, which was previously known as ScoutAbout, was released in April 2002 and Georgia happened to be the first state in which the education software products were sold. He added CCSC has been providing consulting services to numerous state and federal agencies, as well as defense contractors and Fortune 500 companies, for more than 15 years.
A. Stephan Botes categorically denied any conspiracy with Linda C. Schrenko or Merle Temple, Jr. to divert funds to her gubernatorial campaign. He further denied any involvement in fraudulent business transactions between Computer Consulting Services Corporation and the Georgia Department of Education and emphasized each and every contract with the Georgia Board of Education was legitimate and valid, to the best of his knowledge.
TESTING PROTOCOL:
Mr. Botes was advised that the Forensic Psychophysiological Veracity Assessment would be conducted in accordance with the standards of the American College of Forensic Examiners, (ACFE), Objective Scientist Model, which states, "Board Certified Forensic Examiners are not considered advocates, seek only the truth in conducting examinations and report findings in an unbiased and objective manner".
A Forensic Psychophysiological Veracity Assessment was conducted in accordance with professional certification standards for specific incident testing. The test was administered and evaluated using scientific principles and standards of practice set forth by the American Polygraph Association and American Association of Police Polygraphists. The collection of test data was conducted using a Lafayette LX 4000 Computer Polygraph System, which is a state-of-the-art digital polygraph system used by most law enforcement agencies. The test questions format used was a Zone Comparison Testing format (ZCT), which is a control question format developed and modified for use in specific incident testing. The ZCT is professionally recognized as a valid and reliable question format. A recent study conducted by the National Academy of Sciences concluded polygraph testing when using a comparative test question format in specific incident testing, was more reliable and valid than other testing formats. The ZCT is currently used in the training of examiners by the Department of Defense Polygraph Institute (DoDPI), and all polygraph training facilities which have been certified by the American Polygraph Association. The DoDPI is considered to be the premier polygraph training and research facility in the world. The ZCT testing format was also used in the research and development of digital scoring algorithms conducted by the Applied Physics Laboratory, Johns Hopkins University.
The credibility assessment of the examinee consisted of three phases; the pre-test interviews during which the target issues were discussed and the test questions were formulated; the collection of test data during which the psychophysiological responses were monitored and recorded on the test charts; and the post-test phase during which the recorded data were reviewed and evaluated. Each forensic psychophysiological assessment consisted of multiple data charts, recorded, printed and evaluated using the Lafayette LX 4000 computerized polygraph system.
SCOPE OF EVALUATION:
The Forensic Psychophysiological Veracity Assessment of the examinee, which was conducted on December 9, 2004, included the following questions relative to the target issues:
At the time, were you aware that revenue from the CCSC contracts was being diverted into political campaign funds? No
Did you ever participate in an agreement with anyone to divert funds received from the Georgia Department of Education to any political campaign? No
Did you cause any shell corporations to be formed for the purpose of covering up State funds diverted into any political campaign? No
Additional interviews were conducted relative to the business transactions between CCSC and GA DOE. A second test series was administered on February 2, 2005, which included the following relevant test questions.
Were any software product licenses or related support services related to the Georgia Department of Education contracts, withheld from delivery? No
After receiving payments from the Georgia Department of Education in 2002, did your companies make every effort to deliver the software products and services in full accordance with the contracts? Yes
Were the affiliated companies incorporated in July 2002, based upon the advice of BDO Seidman for tax purposes? Yes
EVALUATION OF TEST DATA:
The recorded test data recorded on each of the test series were printed and numerically evaluated using the conventional seven point scoring system, used by federal law enforcement polygraph experts. A global analysis of the entire psychophysiological data, recorded during the testing process on each test series, reflected no significant reactions to the target issues on either test series, which would reflect deceptive criteria. The test data were also electronically reviewed and evaluated using the digital scoring algorithm developed by the Applied Physics Laboratory, Johns Hopkins University, during research conducted by the government.
CONCLUSION:
The overall scoring of the test data collected and recorded for each of the above relevant questions reflected No Deception Indicated. In the opinion of the forensic examiner, the credibility assessment clearly supported the denial of A. Stephan Botes of any participation in any conspiracy to divert federal or state funds into the political campaign of Linda Schrenko or involvement in any effort to defraud the Georgia Department of Education through bogus contracts in providing educational software to Georgia school systems.

Polygraphs just measure whether or not you experience anxiety. You could be anxious about lying or you could be anxious about being convicted for something you did not do. However, a sociopath with no conscience would not experience anxiety and would pass a polygraph.
In your case probably just have no anxiety about lying and no qualms about letting Peter Steyn serve time for YOUR actions.

Every dog has its day.!! I'm generally a compassionate person and my nature is to never bid ill towards anyone. I never wish bad things to happen to anyone. In this case I must make an exception. It's very difficult for me to have compassion for Stephan because he lacked any for me during a critical time which I needed it. Knowing I had reached certain lows in my soul, he seized the opportunity to quash whatever diginty remained. Then he and his brain-washed counterpart decided to spread negative gossip about me without any ability on my part to defend myself.

The sycophantic ramblings of his "fans" are amusing and predictable. I am reasonably certain the comments are mainly from Botes himself. Personally I doubt he still has that many people in thrall.
Yes ... CCSC did enable me to come to the US ... for which I am grateful. But I paid my dues ... worked for CCSC for the full term of my contract at less than HALF the wages being paid to CCSC American contractors at the time. Essentially we were offering indentured servitude under the pretense of a "cultural exchange" visa. Went into it with my eyes wide open recognizing Botes for what he was from the start. But he still tried to screw me over.
That he enabled some of us to immigrate to America does NOT make him a "good guy". He found a way to work the system, as he always does.

I was also one of Stephan's victims. He owes me alot of money and I doubt it if I will ever see it. Believe me, he can promise you one thing and simply do another. I have never met such a sly person in my life.
I truly believe that he is capable of stealing from other people as I know that I was not the only one.
On another issue, CCSC did not rescue us from our countries. I had a good life, as I am sure most of the people who worked at CCSC. People I have spoken to came for the experience as well as being curious. Most of us that work in the IT industry get paid farely well and that is true for most countries. In fact , when I joined CCSC, I took a considerable cut in salary. | |

I have had numerous conversations with Stephan - in fact many during his preparation for his trial. All throughout this time Stephan was always offering to assist me and I truly appreciate his kindness.
Is Stephan arrogant? I would day he is self confident.
Is he in You Face? Only when challenged.
Is he guilty of the crimes of which he is accused? I cannot say for sure since i wasn't there. However I sincerely doubt his guilt. He did NOT need the money. If he wins his appeal I will celebrate with him. If he loses his appeal I will remember how Stephan treated me: with kindness, dignity and respect. If I can help the man in any way I will gladly do so.

Mixed verdicts for Shrenko co-defendents

Even before he was found guilty on federal fraud charges Wednesday, one of former state School Superintendent Linda Schrenko's co-defendants said he wasn't afraid of a stint in prison.
A jury deliberated for about 20 hours before convicting Alpharetta computer executive A. Stephan Botes on conspiracy, theft of federal funds and wire fraud charges for helping to steal more than $600,000 in federal education funds meant for honor and deaf students.
About half of the money Botes' company received was funneled into Schrenko's beleaguered 2002 gubernatorial campaign.
She used more than $9,300 for a face lift.
The conviction ends a hard fought, and at times wacky, four-week trial that included Schrenko's mid-trial plea and the jailing of the government's star witness, Merle Temple, who was Schrenko's former lover and deputy superintendent.
Temple remains jailed, accused of doubled-crossing prosecutors by feeding information on the case to Schrenko and offering to shape his testimony to lessen the blow to his paramour.
Schrenko, in turn, doubled-crossed Temple by tape recording their telephone conversations and handing them to the FBI. Temple is expected to get a lengthy prison sentence.
Schrenko, who pleaded guilty to embezzling and money laundering charges, is headed to prison, too. She agreed to serve eight years behind bars forgoing any appeals,
Another of Botes' co-defendants, Peter Steyn, who was Botes' chief operating officer, was acquitted on all charges.
Botes, who was acquitted on 33 charges dealing mainly with money laundering, plans to appeal his conviction on the remaining 15 charges. He is scheduled to be sentenced Aug. 22.
This won't be his first prison stint.
Botes said that when he was 18, he was sentenced to serve 15 months in solitary confinement in his native South Africa for refusing to join the military and its enforcement of apartheid. When released, in 1976, he weighed less than 120 pounds.
A federal prison in America will be much more tolerable — providing food, reading materials and exercise, he said while waiting for the verdict.
Although he feels confident he'll survive his time in prison, Botes said he wasn't so sure Schrenko would be able to do so. Schrenko, who was already thin, said she dropped 30 pounds from the stress of awaiting trial.
"She's a frail, sickly old woman," Botes said of Schrenko during jury deliberations. "I don't think she'll survive the eight years."
Botes, who studies holistic medicine, said he took Schrenko to a health store in 2002 and tried to persuade her to break her reliance on prescription medicine and switch to vitamins and other natural remedies to curb her depression and neck and back pain.
"But she was too dependent," he said.
While pleading guilty earlier this month, Schrenko told U.S. District Court Judge Clarence Cooper that she is taking more than a dozen medications, including drugs for sleep apnea, narcolepsy, a heart condition and a back problem, circulatory and pulmonary problems and osteoporosis.
She said she is also taking antidepressants and a tranquilizer and has been seeing a psychiatrist since 2003 "when all of this came up."
Prosecutor Russell Vineyard convinced U.S. District Court Judge Cooper to put Botes behind bars immediately as a flight risk, with a pilot's license and an estate overlooking the Indian Ocean in South Africa.
His attorney, Brian Steel, who buried his head on the defense table upon hearing the verdict, lobbied for Botes to remain instead under house arrest wearing an electronic monitoring ankle bracelet.
He said Botes passed a kidney stone Tuesday but didn't seek medical treatment because he didn't want to violate the judge's orders to remain near the courthouse.
Steyn walked out of the courtroom a free man with his wife by his side Wednesday. Steyn grinned and proclaimed: "It's a good day to be an American citizen."

A federal jury in Atlanta returned verdicts of guilty late Wednesday morning against businessman Stephan Botes, who was on trial accused of helping former Georgia School Superintendent Linda Schrenko steal federal money from school children in 2002.
The jury declared the other defendant, Peter Steyn, not guilty.
Schrenko had changed her plea to guilty during the trial and testified for the government.
The jury found Botes guilty of 15 of the 48 counts against him:
One count of Conspiracy
All 11 counts of Theft of Federal Funds
Three of nine counts of Wire Fraud.
The jury acquitted Botes of all of the Money Laundering counts against him.
The jury found Steyn not guilty of all 22 counts against him, including conspiracy, theft of federal funds and wire fraud.
Jurors worked since Thursday afternoon to arrive at the verdicts -- arguing with each other, and meticulously pouring over the evidence in each count.
“Well, it was a very difficult case to decide,” Jury forewoman Ashley Elkins told 11Alive News, “because a lot of it did have facts and some of it was questionable. There was definitely a crime committed, but we did not necessarily know if the people involved were intending to commit these crimes.”
Juror Kim Earles said, “A few people [were] swaying different ways,” during deliberations, “and we were clashing a little bit.”
Elkins and the eleven other jurors ultimately decided that the evidence proved Atlanta businessman Stephan Botes schemed with former Georgia School Superintendent Linda Schrenko in 2002 to steal $614,000 of federal education funds earmarked for deaf students and honors students in Georgia.
Prosecutors detailed for the jury an elaborate money laundering scheme that involved phony state contracts to Botes’ companies, with part of the money kicked back to Schrenko.
Schrenko spent part of her share of the money on her 2002 campaign for governor, and, after she lost, on her face lift.
Juror Janice Harris said jurors agonized over the case during deliberations, keeping in mind that the losers in the scheme were Georgia school children.
“And we actually even had prayer during deliberations,” Harris said, “to come up with the right verdict, because of the children.”
Some jurors left the federal courthouse thinking both men are guilty of everything.
“I felt that [they] were guilty of all the counts,” said juror Wade Fogarty, “however, the evidence wasn’t there to support that, and we wanted to make sure we were making our verdict based on the evidence.”
Jury forewoman Ashley Elkins said jurors might have acquitted Linda Schrenko, if Schrenko had not pleaded guilty during the trial.
“It was definitely shocking for us,” Elkins said. “Each of us was shocked to find out that she did plead guilty, especially after little evidence, as it was, brought forth against her thus far in the trial.”
In all, federal prosecutors, after three and a half years investigating this case, will be putting six people in federal prison -- five, like Schrenko, who pleaded guilty, and one -- Botes -- who was convicted.
“This is the kind of case that we want to do,” said U.S. Attorney David Nahmias. “It brings to justice people who were violating the public trust, and there is really nothing more important that we do on a day to day basis.”
As for Peter Steyn, he smiled in relief after hearing the jury declare him not guilty, and he embraced his attorney, Andy Ekonomou. Then they left the courthouse without comment.
Stephen Botes was immediately taken into federal custody to await sentencing, scheduled for August.
Botes’ attorney, Brian Steel, said Botes remains optimistic.
“He [Botes] says, '33 counts were wonderful, and we’re going to, God willing, win the other 15 counts on appeal.'”
Juror Elaine Simmons said the verdict should serve as a warning to government employees and politicians.
“This should make administrators and the people who are at a high level think twice about what they’re doing,” Simmons said, “and think about where the [taxpayers’] money should go. And I’m sure that it’s easy to be pulled into, you know, ‘This money is here and let’s use it for whatever we want,’ but they should think twice about it because it can come down to this [guilty verdicts and prison].”
“It was definitely a shame that money was misspent,” forewoman Elkins said, “however we did want to stay objective and not put our emotions into the verdict.”
Schrenko is expected to be sentenced, in July, to eight years in federal prison. Botes faces an even longer prison term when he is sentenced in August.

On many occasions we would discuss Atheism and he was an avid follower of Ayn Rand. He never mentioned a "guardian angel" which looked over him. His guardian angel wasn't by his side when the verdicts were read.
He forgot if he was going to truly adhere to the Randian philosophy and reject religion as mysticism there's still an absolute level of moral code that comes along with it. What he did was purely in his self interest with no benefit to anyone but himself. No product was created, no outcome was to the benefit of his fellow man. Ultimately it hurt children.
There was no justification philosophically for what he did. Even if there were, Rand would state that the individual must live within the boundaries of the laws created by men. You are free to rail against the system and try to change it but that doesn't justify you breaking the law simply because it gets in the way of furthering your self sufficiency or wealth. | |

I worked for him too. I am also an athiest and have never committed any crime nor any immoral act. It has nothing to do with religion. Stephan is a sicko. In fact he was NOT an atheist. He believed he had a guardian angel and used to speak about this guardian angel all the time. Basically he is sick. I think his attorney should cut the crap with him and ask for a psychiatric review before he is sentenced.
I have no doubt that Stephan did not only steal the money, but was the main organizer and schemer behind this. He thinks he is smarter than anyone, above the law and can do whatever he likes.
He lived the most licentious life style and often did not pay his people just so that he could go on holiday or throw a lavish party.
In fact, there are many folks who worked for him that he had not paid in months. I believe there are several lawsuits out because he decided he was entitled to not pay people whenever he felt like it.

A jury returned mixed verdicts Wednesday in the federal corruption case against co-defendants of former Georgia School Superintendent Linda Schrenko, who pleaded guilty to embezzling more than $600,000 in education funds earmarked for deaf and honors students.
Multimillionaire A. Stephan Botes was found guilty of conspiracy, theft of federal funds and wire fraud charges. He was found not guilty on money laundering charges.
Co-defendant Peter Steyn, chief operating officer at Botes' computer consulting firm, was found not guilty on all charges.
The jury had deliberated about 20 hours on the charges against the two men. Sentencing will take place at a later date.
Prosecutors said Botes, whose financial empire was in jeopardy, joined forces with Schrenko, who was desperate for quick cash for her doomed 2002 gubernatorial race.
They say Botes directed Steyn and others in his company to divert money meant for computer services for deaf and honors students into Schrenko's campaign. In exchange, Botes' company would land a $2.5 million contract with the state Department of Education.
Schrenko said she was innocent but pleaded guilty during the second week of the trial to embezzling and money laundering charges. She agreed to serve an eight-year prison stint and forgo any appeals.

The jury has it and yeah, while some of Botes' attorney's arguments were truly laughable ... he may get off. Even though there’s some pretty damning evidence still unexplained. Of course, it is not encumbent upon his attorney to “explain” anything. The burden of proof is on the prosecution and I sure hope they are doing a better job than they appear to be doing, at least as portrayed in the media.
In Botes' case in particular, there is the matter of Johannes Potgieter, who testified that Botes asked him to write a check for $10,000 to a creditor of Linda Shrenko’s campaign and that he, Botes, then reimbursed Potgieter for this amount through a bank wire. All documentation was shown in court. Shrenko also testified that she, Temple and Botes had a private meeting at a Buckhead pub sometime as late as 2004, at which Botes and Temple checked each other for wires, agreed on secret codes they would send each other if either of them sensed that they were being investigated by the FBI, and Botes handed Temple a contract for the ‘services’ Temple had performed for CCSC back in 2002. Part of the paper trail they tried to create after the fact. They were all well aware that their scheme was illegal.
How much Steyn knew is moot ... he is stuck with the undeniable fact that his signature is on each of those $590 ‘focus group’ checks.
It will be interesting to see what the jury decides. As I said before ... regardless ... I firmly believe that Botes is guilty. He is guilty of so many other shady deals ... this time he got caught, at least I hope so.

Just listening to the testimony by his attorney towards the Jury is fascinating and laughable. Botes maintains he's innocent and has no knowledge of funneling the campaign monies via CCSC. Trust me, he is not "burned out", unaware, "out of touch", etc.
A CEO of a corporation must be willing to assume full responsibility whether he's engaged in illegal schemes or participated by others as Botes contends. Agreeably with the previous poster; he is a micro-manager fully cognizant of the internal day to day operations of his company. His paranoia is just a signal of a more deep-rooted emotional problem. Most psychologists agree that there is little evidence that polygraph tests can accurately detect lies.
Findings
Lie detector tests have become a popular cultural icon - from crime dramas to comedies to advertisements - the picture of a polygraph pen wildly gyrating on a moving chart is readily recognized symbol. But, as psychologist Leonard Saxe, PhD, (1991) has argued, the idea that we can detect a person's veracity by monitoring psychophysiological changes is more myth than reality. Even the term "lie detector," used to refer to polygraph testing, is a misnomer. So-called "lie detection" involves inferring deception through analysis of physiological responses to a structured, but unstandardized, series of questions.
The instrument typically used to conduct polygraph tests consists of a physiological recorder that assesses three indicators of autonomic arousal: heart rate/blood pressure, respiration, and skin conductivity. Most examiners today use computerized recording systems. Rate and depth of respiration are measured by pneumographs wrapped around a subject's chest. Cardiovascular activity is assessed by a blood pressure cuff. Skin conductivity (called the galvanic skin or electrodermal response) is measured through electrodes attached to a subject's fingertips.
The recording instrument and questioning techniques are only used during a part of the polygraph examination. A typical examination includes a pretest phase during which the technique is explained and each test question reviewed. The pretest interview is designed to ensure that subjects understand the questions and to induce a subject's concern about being deceptive. Polygraph examinations often include a procedure called a "stimulation test," which is a demonstration of the instrument's accuracy in detecting deception.
Several questioning techniques are commonly used in polygraph tests. The most widely used test format for subjects in criminal incident investigations is the Control Question Test (CQT). The CQT compares responses to "relevant" questions (e.g., "Did you shoot your wife?"), with those of "control" questions. The control questions are designed to control for the effect of the generally threatening nature of relevant questions. Control questions concern misdeeds that are similar to those being investigated, but refer to the subject's past and are usually broad in scope; for example, "Have you ever betrayed anyone who trusted you?"
A person who is telling the truth is assumed to fear control questions more than relevant questions. This is because control questions are designed to arouse a subject's concern about their past truthfulness, while relevant questions ask about a crime they know they did not commit. A pattern of greater physiological response to relevant questions than to control questions leads to a diagnosis of "deception." Greater response to control questions leads to a judgment of nondeception. If no difference is found between relevant and control questions, the test result is considered "inconclusive."
An alternative polygraph procedure is called the Guilty Knowledge Test (GKT). A GKT involves developing a multiple-choice test with items concerning knowledge that only a guilty subject could have. A test of a theft suspect might, for example, involve questions such as "Was $500, $1,000, or $5,000 stolen?" If only a guilty suspect knows the correct answer, a larger physiological reaction to a correct choice would indicate deception. With a sufficient number of items, a psychometrically sound evaluation could be developed. GKTs are not widely employed, but there is great interest in doing so. One limitation of the GKT is that it can be used only when investigators have information that only a guilty subject would know. The interpretation of "no deception" is also a potential limitation, since it may indicate lack of knowledge rather than innocence.
The accuracy (i.e., validity) of polygraph testing has long been controversial. An underlying problem is theoretical: There is no evidence that any pattern of physiological reactions is unique to deception. An honest person may be nervous when answering truthfully and a dishonest person may be non-anxious. Also, there are few good studies that validate the ability of polygraph procedures to detect deception. As Dr. Saxe and Israeli psychologist Gershon Ben-Shahar (1999) note, "it may, in fact, be impossible to conduct a proper validity study." In real-world situations, it's very difficult to know what the truth is.
A particular problem is that polygraph research has not separated placebo-like effects (the subject's belief in the efficacy of the procedure) from the actual relationship between deception and their physiological responses. One reason that polygraph tests may appear to be accurate is that subjects who believe that the test works and that they can be detected may confess or will be very anxious when questioned. If this view is correct, the lie detector might be better called a fear detector.
Some confusion about polygraph test accuracy arises because they are used for different purposes, and for each context somewhat different theory and research is applicable. Thus, for example, virtually no research assesses the type of test and procedure used to screen individuals for jobs and security clearances. Most research has focused on specific incident testing. The cumulative research evidence suggests that CQTs detect deception better than chance, but with significant error rates, both of misclassifying innocent subjects (false positives) and failing to detect guilty individuals (false negatives).
Research on the processes involved in CQT polygraph examinations suggests that several examiner, examinee, and situational factors influence test validity, as may the technique used to score polygraph charts. There is little research on the effects of subjects' differences in such factors as education, intelligence, or level of autonomic arousal.
Evidence indicates that strategies used to "beat" polygraph examinations, so-called countermeasures, may be effective. Countermeasures include simple physical movements, psychological interventions (e.g., manipulating subjects' beliefs about the test), and the use of pharmacological agents that alter arousal patterns.
Despite the lack of good research validating polygraph tests, efforts are on-going to develop and assess new approaches. Some work involves use of additional autonomic physiologic indicators, such as cardiac output and skin temperature. Such measures, however, are more specific to deception than polygraph tests. Other researchers, such as Frank Andrew Kozel, MD, have examined functional brain imaging as a measure of deception. Dr. Kozel's research team found that for lying, compared with telling the truth, there is more activation in five brain regions (Kozel et al., 2004). However, the results do not currently support the use of fMRI to detect deception in real world individual cases.
Significance & Practical Application
Polygraph testing has generated considerable scientific and public controversy. Most psychologists and other scientists agree that there is little basis for the validity of polygraph tests. Courts, including the United States Supreme Court (cf. U.S. v. Scheffer, 1998 in which Dr.'s Saxe's research on polygraph fallibility was cited), have repeatedly rejected the use of polygraph evidence because of its inherent unreliability. Nevertheless, polygraph testing continues to be used in non-judicial settings, often to screen personnel, but sometimes to try to assess the veracity of suspects and witnesses, and to monitor criminal offenders on probation. Polygraph tests are also sometimes used by individuals seeking to convince others of their innocence and, in a narrow range of circumstances, by private agencies and corporations.
The development of currently used "lie detection" technologies has been based on ideas about physiological functioning but has, for the most part, been independent of systematic psychological research. Early theorists believed that deception required effort and, thus, could be assessed by monitoring physiological changes. But such propositions have not been proven and basic research remains limited on the nature of deceptiveness. Efforts to develop actual tests have always outpaced theory-based basic research. Without a better theoretical understanding of the mechanisms by which deception functions, however, development of a lie detection technology seems highly problematic.
For now, although the idea of a lie detector may be comforting, the most practical advice is to remain skeptical about any conclusion wrung from a polygraph.

PURPOSE OF REQUEST:
Howard J. Weintraub, Attorney at Law, contacted the Federal Polygraph Associates, LLC, Atlanta, Georgia, and requested a forensic credibility assessment of his client, A. Stephan Botes. Mr. Botes is the Chairman and Chief Executive Officer of Computer Consulting Services Corporation (CCSC), as well as other affiliated companies, including Uniting Networks, Inc. and Global Executive Management, LLC. Mr. Botes was charged in a federal indictment alleging that Mr. Botes conspired with Linda C. Schrenko, State Superintendent of Schools and Merle Temple, Jr., former Deputy State School Superintendent, and others, to defraud the Georgia Department of Education in 2002. Linda C. Schrenko was a candidate for Governor of Georgia in 2002 and Merle Temple Jr., served as a consultant to the State School Superintendent. Mr. Botes was alleged to have participated in a scheme with Linda C. Schrenko and Merle Temple, Jr. to defraud the Georgia Department of Education through materially false pretenses by causing checks to be issued by the State of Georgia in excess of $500,000 for goods and services never received. Mr. Botes was also charged with directing the CCSC Comptroller to divert funds received from the Georgia Department of Education into the gubernatorial campaign funds of Ms. Schrenko.

RIGHTS AND TESTING PROCEDURES:
Mr. A. Stephan Botes was scheduled for forensic interview and testing by Richard D. Rackleff, Board Certified Forensic Examiner, American Board of Forensic Examiners. Prior to conducting any assessment of Mr. Botes’ credibility, the scientific basis of the polygraph procedures were explained in detail to the examinee and he was advised the testing would be conducted and evaluated using professional testing standards and scientific procedures which had been validated through continuous research in the scientific community. The examinee was advised that his participation in a forensic polygraph evaluation would be completely voluntary. He was provided with a Statement of Consent and Waiver, which he read and verified with his signature. The examinee was encouraged to be completely truthful during the testing process and was advised a Forensic Polygraph Report would be made available to his attorney, relative to his credibility.
The initial interview of Mr. Botes was conducted on December 1, 2004, at which time he provided personal background information and details of his involvement with Linda C. Schrenko and Merle Temple, Jr. in the gubernatorial campaign in 2002. A Forensic Psychophysiological Veracity Assessment was then scheduled and conducted on December 9, 2004, relative to his denial of any knowledge or involvement in diverting funds to the gubernatorial campaign of Linda C. Schrenko.
A. Stephan Botes was again interviewed on January 27, 2005 relative to the business transactions between his company, Computer Consulting Services Corporation (CCSC), and the Georgia Department of Education (GA DOE), through the offices of Linda C. Schrenko. A second Forensic Psychophysiological Assessment was then conducted on February 2, 2005, relative to the charges and allegation that the contracts between the CCSC and the GA DOE were a scam and no goods or services were ever provided to the State of Georgia by CCSC.
PRE-TEST INTERVIEW:
During the interview on December 1, 2004, the examinee voluntarily provided identifying and background information. Mr. Botes provided complete background and history of CCSC, which was started in 1982. Mr. Botes has served as President and CEO of CCSC since 1986. Uniting Networks, Inc. was started in 1987 and Global Executive Management Ltd. was started in 1998. He explained other companies were formed with separate product lines, including MyCommunityServer, SchoolServer, MaestroPro and PowerResearcher. Jonathan “Johnny” Turner started in the company in a clerical position in accounting in 1998 and moved up the ranks until he became Vice President of Finance.
Around January 2002, Johnny Turner introduced his friend, Rodney Estrada to Mr. Botes. Mr. Estrada was an Educational Technology Consultant who had connections with several State Departments of Education, including Georgia. Mr. Estrada was interested in representing Mr. Botes’ software to various school systems and started working as a consultant to CCSC in February 2002. The schools were interested in the No Child Left Behind Program which required them to have a student information management system, which the SchoolServer. product provided. Representatives of CCSC had first approached the State School Superintendent, Linda Schrenko, in April 1999 with their software product, MaestroPro, which was marketed as an intellectual capacity expander. The product was effective in teaching students study methodology. Rodney Estrada arranged a meeting with Linda Schrenko in April 2002; at which time the software products were demonstrated. The Superintendent was very interested and agreed to purchase the PowerResearcher software product for the Governor’s Honors Program in Valdosta, in June 2002.
Rodney Estrada, who was also a fundraiser for political campaigns, approached Mr. Botes about using his home for a fundraiser for Ms. Schrenko, who was a candidate for Governor. Mr. Estrada arranged the fundraiser and only a few people were present, including Linda Schrenko and her campaign manager, Richard Leonard, in addition to CCSC employees. The employees were encouraged to donate $100 each and Mr. Botes gave $100, which he stated were the only funds he ever donated to the Linda Schrenko campaign. Rodney Estrada was working with other political candidates, including Mike Beatty for Lieutenant Governor, Kathy Cox, Republican candidate for State School Superintendent, and Joe Martin and Barbara Christmas, both Democratic candidates for State School Superintendent. Mr. Estrada also used the clubhouse in Mr. Botes’ community to have a fundraiser for Kathy Cox, Mike Beatty and Linda Schrenko. Stephan Botes specifically denied any knowledge or involvement in forming the company known as Curti Consulting Group International, which was formed by Johnny Turner and Rodney Estrada, for political action interests.
The GA DOE awarded Mr. Botes’ company two Governors Honors Program contracts in June 2002. The company created a GA DOE requested website for such purpose, installed the software on the lab computers in Valdosta, taught two classes for teachers and students on the use of the software, created and conducted surveys for a Needs Assessment Report and provided support and maintenance personnel for the duration. The Needs Assessment Report was delayed due to a lack of response from the GA DOE, resulting in several extensions of the delivery date, and final delivery on December 31, 2002.
In early June 2002, CCSC was also requested to make presentations to, and do proposals for, the School District in Richmond County and the School District of Emanuel County, both $2.5 million contracts. While awaiting approval on those contracts, CCSC was awarded another $2.5 million contract by the GA DOE on July 21, 2002, and 15,000 PowerResearcher and MaestroPro software license keys were delivered and signed for by Ms. Schrenko. Mr. Botes’ companies were also awarded eleven contracts by the GA DOE for their software and services, to benefit the Schools for the Deaf. Mr. Botes claimed his companies delivered everything that was in their power to deliver, including all the license keys for the software purchased, but were prevented from completing delivery because of the political conflict and infighting between Linda Schrenko and the State Board of Education. Mr. Botes’ companies received a letter from the Chairperson of the State Board of Education in late August 2002, challenging Schrenko’s authority to have entered into those contracts. Mr. Botes instructed CCSC legal counsel to contact the State Attorney General. They received on opinion letter from the State Attorney General on March 28, 2002 which confirmed the authority of the State School Superintendent to issue multiple contracts with Mr. Botes’ companies. They were prevented from completing delivery due to the lack of responses from GA DOE personnel. In late November 2002, they received another notice that the State Board of Education had voted to void the contracts
Mr. Botes explained the contracts required specialized customization, support and maintenance, for which qualified employees were held on standby through the end of December 2002. He added their software was subsequently installed by the GA DOE, at the GA Educators Training and Technology Center (ETTC), where teachers were instructed on the use of the software in teaching students on conducting online research.
Although issuing “Focus Group” checks would not have been unusual for his company, Stephan Botes was not aware that Johnny Turner dispersed 54 such checks from Mr. Botes’ companies designated for “Focus Group Honoraria” nor was he aware of the 50 additional checks dispensed through two other companies in which Mr. Botes had no knowledge or affiliation, but apparently controlled by Johnny Turner and his father. Mr. Botes’ added his companies had demonstrated their products to two large focus groups in March 2002, for which each attendee, teacher, student and businessman, was paid $350 for a four-hour session. The survey data were collected through April, 2002 and the sessions were recorded and considered very useful in marketing and improving their software.
Mr. Botes insisted that he was unaware of the amounts of cash dispersals which Mr. Turner was drawing from the company pursuant to the GA DOE contracts. The only payments Mr. Botes authorized were pursuant to an agreement with Merle Temple, Jr. for commissions on the $2.5 million contract Temple had procured with the GA DOE on July 21, 2002. Stephan Botes confirmed that affiliated companies were formed in June, 2002, to represent each of his software products, and based upon the professional advice of his auditors, BDO Seidman. He denied any affiliated companies were formed for the purpose of concealing any diversion of funds to the Georgia School Superintendent or her associates.
Mr. Botes emphasized that CCSC has conducted business transactions in more than thirty States and numerous foreign countries for over two decades, without any questionable transactions or accusation of fraud. The PowerResearcher product, which was previously known as ScoutAbout, was released in April 2002 and Georgia happened to be the first state in which the education software products were sold. He added CCSC has been providing consulting services to numerous state and federal agencies, as well as defense contractors and Fortune 500 companies, for more than 15 years.
A. Stephan Botes categorically denied any conspiracy with Linda C. Schrenko or Merle Temple, Jr. to divert funds to her gubernatorial campaign. He further denied any involvement in fraudulent business transactions between Computer Consulting Services Corporation and the Georgia Department of Education and emphasized each and every contract with the Georgia Board of Education was legitimate and valid, to the best of his knowledge.
TESTING PROTOCOL:
Mr. Botes was advised that the Forensic Psychophysiological Veracity Assessment would be conducted in accordance with the standards of the American College of Forensic Examiners, (ACFE), Objective Scientist Model, which states, "Board Certified Forensic Examiners are not considered advocates, seek only the truth in conducting examinations and report findings in an unbiased and objective manner".
A Forensic Psychophysiological Veracity Assessment was conducted in accordance with professional certification standards for specific incident testing. The test was administered and evaluated using scientific principles and standards of practice set forth by the American Polygraph Association and American Association of Police Polygraphists. The collection of test data was conducted using a Lafayette LX 4000 Computer Polygraph System, which is a state-of-the-art digital polygraph system used by most law enforcement agencies. The test questions format used was a Zone Comparison Testing format (ZCT), which is a control question format developed and modified for use in specific incident testing. The ZCT is professionally recognized as a valid and reliable question format. A recent study conducted by the National Academy of Sciences concluded polygraph testing when using a comparative test question format in specific incident testing, was more reliable and valid than other testing formats. The ZCT is currently used in the training of examiners by the Department of Defense Polygraph Institute (DoDPI), and all polygraph training facilities which have been certified by the American Polygraph Association. The DoDPI is considered to be the premier polygraph training and research facility in the world. The ZCT testing format was also used in the research and development of digital scoring algorithms conducted by the Applied Physics Laboratory, Johns Hopkins University.
The credibility assessment of the examinee consisted of three phases; the pre-test interviews during which the target issues were discussed and the test questions were formulated; the collection of test data during which the psychophysiological responses were monitored and recorded on the test charts; and the post-test phase during which the recorded data were reviewed and evaluated. Each forensic psychophysiological assessment consisted of multiple data charts, recorded, printed and evaluated using the Lafayette LX 4000 computerized polygraph system.
SCOPE OF EVALUATION:
The Forensic Psychophysiological Veracity Assessment of the examinee, which was conducted on December 9, 2004, included the following questions relative to the target issues:
At the time, were you aware that revenue from the CCSC contracts was being diverted into political campaign funds? No
Did you ever participate in an agreement with anyone to divert funds received from the Georgia Department of Education to any political campaign? No
Did you cause any shell corporations to be formed for the purpose of covering up State funds diverted into any political campaign? No
Additional interviews were conducted relative to the business transactions between CCSC and GA DOE. A second test series was administered on February 2, 2005, which included the following relevant test questions.
Were any software product licenses or related support services related to the Georgia Department of Education contracts, withheld from delivery? No
After receiving payments from the Georgia Department of Education in 2002, did your companies make every effort to deliver the software products and services in full accordance with the contracts? Yes
Were the affiliated companies incorporated in July 2002, based upon the advice of BDO Seidman for tax purposes? Yes
EVALUATION OF TEST DATA:
The recorded test data recorded on each of the test series were printed and numerically evaluated using the conventional seven point scoring system, used by federal law enforcement polygraph experts. A global analysis of the entire psychophysiological data, recorded during the testing process on each test series, reflected no significant reactions to the target issues on either test series, which would reflect deceptive criteria. The test data were also electronically reviewed and evaluated using the digital scoring algorithm developed by the Applied Physics Laboratory, Johns Hopkins University, during research conducted by the government.
CONCLUSION:
The overall scoring of the test data collected and recorded for each of the above relevant questions reflected No Deception Indicated. In the opinion of the forensic examiner, the credibility assessment clearly supported the denial of A. Stephan Botes of any participation in any conspiracy to divert federal or state funds into the political campaign of Linda Schrenko or involvement in any effort to defraud the Georgia Department of Education through bogus contracts in providing educational software to Georgia school systems.

I know Stephan Botes, and anyone hes involved with can only be as crooked as he is, he is evil in ways the normal human cannot even contemplate. He'll brobebly just pay everybody off like he usually does.
